I Sverige har inte barn som bevittnat våld i nära relation målsägandestatus, d.v.s. straffrättslig status som brottsoffer, något som kritiserats av FN:s barnkommitté. Ett barn som har bevittnat våld i nära relation ses med dagens svenska reglering däremot som ett brottsoffer i ordets vida betydelse. Detta genom att barnet sedan 2006 har möjlighet att ansöka om s.k. bevittnandeersättning från BrOM.
